Wildly Kreativ Terms & Conditions

1.1 Quotes and estimates are free of charge and “the client” is under no obligation, until the quote is signed and accepted.
1.2 Quotes are valid for 30 days.
1.3 Prices and estimates are not binding.
1.4 If “the client” supplies a budget Wildly Kreativ Design Studio can quote around it.
1.5 The date of completion (DoC) of a project is affected by feedback and receiving of content from “the client” and timelines will be adjusted accordingly.
1.6 Wildly Kreativ Design Studio cannot be held responsible for delays outside our control e.g. equipment failure, weather, and power outages.
1.7 If there is a need for a courier, fees will be billed to “the client”.

2.1 Wildly Kreativ Design Studio can be reached by telephone from Monday to Thursday between 8:00am and 16:30pm and on Fridays between 08:00 and 15:00pm.
2.2 WhatsApp messages are welcome on 078 550 6758
2.3 It is encouraged that the majority of communication be done through email and WhatsApp. This ensures that both parties keep track of specific design requirements and potential changes.
2.4 Any meetings scheduled by “the client” must be done 48 hours prior to meeting, unless another arrangement has been made between Wildly Kreativ Design Studio and “the client”.

3.1 Estimated time of delivery for Graphic Design is 7 to 14 working days, except for items quoted hourly.
3.2 All designs and artwork remain the property of Wildly Kreativ Design Studio until final payment is made.
3.3 No artwork will be released without final payment.
3.4 When originally proposed concepts or design briefs are altered, additional fees will be charged.
3.5 Fully paid designs will be supplied in JPEG, PDF, and PNG form.
3.6 Wildly Kreativ Design Studio is not responsible for backing up final designs after final sign-off and delivery.
3.7 Wildly Kreativ Design Studio is not responsible for corresponding with Printer or Publication companies unless otherwise arranged.
3.8 By placing the order and/or paying the deposit “the client” thereby except all terms and conditions as stated above.

4.1 Once “the client” accepts the quote, the 50% non-refundable deposit must be paid before the project can start.
4.2 Wildly Kreativ Design Studio can complete a website within 14 working days as long as “the client” supplies all the information within 7 working days from the start of the project.
4.3 We can provide a discount if more than one website is done.
4.4 On completion of any Website Design work “the client” will be notified and have the opportunity to review it. “The client” must notify Wildly Kreativ Design Studio of any changes to be made within 7 days. Any of the changes that have not been reported in writing to Wildly Kreativ Design Studio within the 7-day review period will be deemed to have been approved. Minor changes are allowed in the review period.

4.5 Minor Website changes include:
4.5.1 Small textual changes
4.5.2 Small adjustments to placement of items on the page

4.6 Minor changes exclude:
4.6.1 Image Changes
4.6.2 Colour scheme changes
4.6.3 Navigation Changes

4.7 Website changes must be notified in email or writing.
4.8 Wildly Kreativ Design Studio does not take responsibility for any grammar and/or spelling errors in the uploaded context of your website. All content supplied to Wildly Kreativ Design Studio must be proofread and supplied electronically.
4.9 Any grammar and/or spelling errors due to “the clients” fault will be charged accordingly to fix.
4.10 We can add additional modules and pages to the website at any time. This will be quoted and billed separately.
4.11 Wildly Kreativ Design Studio cannot accept responsibility for web pages that do not display correctly in new versions of browsers released after the website has been designed and handed over to “the client”. Wildly Kreativ Design Studio reserves the right to quote for any work involved in changing the website design or code to work with the updated software.
4.12 Wildly Kreativ Design Studio cannot guarantee correct functionality with all browser software across different operating systems.
4.13 Wildly Kreativ Design Studio does not take any responsibility if “the clients” website security is compromised by either a hacker or malicious code if you do not host with our business partner.
4.14 A temporary link will be provided to preview the website prior to going live.
4.15 Wildly Kreativ Design Studio reserves the right to deactivate a website if there is an outstanding amount.
4.16 If a website is not paid in full, it will be deactivated.
4.17 By placing the order and/or paying the deposit “the client” hereby accepts all terms and conditions as stated above.

5.1 If “the client” does not pay for basic SEO, “the clients” website will not be optimized for Search Engine (Google) searches.
5.2 Basic SEO does not include 1st-page rankings with Google or any other Search Engines.

5.3 Wildly Kreativ Design Studio includes the following with website design:
5.3.1 Basic Keywords built into pages.
5.3.2 Website description built into header.
5.3.3 Search Engine Friendly (SEF) URL’s.

5.4 SEO results may vary and can take up to 4-6 weeks to be indexed with Google after the website has been completed.

6.1 Delivery of artwork consists of the following:
6.1.1 Supply of final artwork to the chosen printer
6.1.2 Via Email
6.1.3 Uploaded to ISP (in the case of Web Design and Development)

6.2 No final artwork or files will be delivered until final payment is made in full.
6.3 Please ensure that you have Copyright for all material supplied.
6.4 Information (word/txt), as well as logos and artwork (photographs) to be used/adjusted, must be supplied electronically unless they are to be created as part of the project.
6.5 “The client” is responsible for maintaining their own backups. Wildly Kreativ Design Studio will not be liable for restoring any client data or client website except to the extent that such data loss arises out of a negligent act or omission by us. We do offer backups of your website for a set fee.
6.6 “The client” allows Wildly Kreativ Design Studio to place a link to Wildly Kreativ Design Studio's own website on “the clients” website, if not agreed otherwise by “the client” and Wildly Kreativ Design Studio.
6.7 “The client” agrees to allow Wildly Kreativ Design Studio to place all designs on Wildly Kreativ Design Studio's own website for portfolio and demonstration purposes and to use any designs in its own publicity unless “the client” has given explicit written instruction not to.

7.1 On completion of any work (Graphic Design & Website Design) “the client” will be notified and have the opportunity to review it. “The client” must notify Wildly Kreativ Design Studio within 7 days of such notification. Any of the work that has not been reported in writing to Wildly Kreativ Design Studio within the 7-day review period will be deemed to have been approved.
7.2 All changes must be requested in writing.
7.3 Any additional work, author’s changes or ad hoc changes and updates will be charged at an hourly rate (dependant on task) or will be quoted separately.

8.1 All services provided by Wildly Kreativ Design Studio shall be for the exclusive use of “the client” other than the designer’s promotional use. Upon payment of all fees, the following reproduction rights for all approved final designs created by Wildly Kreativ Design Studio for the project shall be granted:
8.1.1 “The client” to gain full transferable rights to the brand identity.
8.1.2 “The client” to gain full license to reproduce works through commercial printers.

8.2 Construction Files (unused concepts, revision files, fonts, Photoshop Layered Files, CorelDraw Files, and Adobe Illustrated Files) remain the property of Wildly Kreativ Design Studio unless arranged otherwise.
8.3 In the case of Web Development and Design, the files are based on a non-exclusive code base created and maintained by Wildly Kreativ Design Studio. In some cases, existing code was used to help create the deliverables. Such code and other underlying technologies do NOT become the property of “the client”.

9.1 Wildly Kreativ Design Studio may utilize the services of subcontractors to fulfil any or all of its obligations under this Agreement.
9.2 Any third party Terms and Conditions will include full reproduction rights for the client. Where such contracting add to the project costs “the client” will first be asked permission to proceed.

10.1 Wildly Kreativ Design Studio (and any subcontractors we engage) agree that we will not at any time disclose any of your confidential information to any third party.
10.2 “The client” shall also inform Wildly Kreativ Design Studio in writing before the project commence if any material or information provided by the client or if any portion of the project is confidential.

11.1 50% non-refundable deposit of the quoted amount is required before Wildly Kreativ Design Studio will commence with the project.
11.2 The project deposit is non-refundable and if a project is cancelled by “the client” for whatever reason, the deposit will serve as a cancellation fee, along with a prorated payment based upon the time spent.
11.3 No final artwork or files will be delivered until final payment is made.
11.4 In the event that “the client” has made an arrangement with Wildly Kreativ Design Studio to receive finished artwork before, payment needs to be made no later than 7 days after the completion of the project.
11.5 Work in progress will be billed monthly according to the amount of work that has been completed. This is payable within 7 days of the statement date.

12.1 In the event that “the client” for whatever reason cancel the project, the following cancellation fees apply:
12.1.1 20% of the remaining fee if project is further along than 70%.
12.1.2 30% of the remaining fee if project is further along than 80%.
12.1.3 100% of the remaining fee if project is further along than 90% or complete.
